Introduction: One of the basic principles of the English constitution is the rule of law. This doctrine is accepted in the constitution of U. S. A. and also in the constitution of Bangladesh. Now a day’s rule of law is one of the most discussed subjects of developing countries. Developed countries and donor agencies always instruct the developing countries for sustainable development and good governance. Actually sustainable development and good governance mostly depends on the proper application of rule of law. Laws are made for the conflicting forces in society. One of the prime objects of making laws is to maintain law and order in society, a peaceful environment for the progress of the people. In true and real sense there is no rule of law in Bangladesh today. Law in Bangladesh follows a course of selective and discretionary application. Institution and procedures required for ensuring rule of law also are no effective in the country. Main Concept of Rule of Law: The term ‘Rule of Law’ is derived from the French phrase ‘La Principe de Legality’ (the principle of legality) which referse to a government based on principles of law and not of men. In this sense the concept of ‘La Principe de Legality’ was opposed to arbitrary powers. The rule of law is old origin. In thirteenth century Bracton, a judge in the Reign of Henry III wrote- â€Å"The king himself ought to be subject to God and the law, because law makes him king. † Edward Coke is said to be the originator of this concept, when he said that the king must be under God and law and thus vindicated the supremacy of law over the pretensions of the executives. Professor A. V. Dicey later developed on this concept in his classic book ‘The Law of the Constitution. ‘ published in the year 1885. Dicey’s concept of the rule of law contemplated the absence of wide powers in the hands of government officials. According to him wherever there is desecration there is room for arbitrariness. The rule of law is a viable and dynamic concept and like many other such concepts, is not capable of any exact definition. Its simplest meaning is that everything must be done according to law, but in that sense it gives little comfort unless it also means that the law must not give the government too much power. The rule of law is opposed to the rule of arbitrary power. The primary meaning of rule of law is that the ruler and the ruled must be subject to law and no one is above 3. the law and hence accountable under the law. It implies the supremacy of law and the recognition that the law to be law can not be capricious. What is the Rule of Law? The rule of law is a system in which the following four universal principles are upheld: 1. The government and its officials and agents as well as individuals and private entities are accountable under the law. 2. The laws are clear, publicized, and stable and just, are applied evenly, and protect fundamental rights, including the security of persons and property. 3. The process by which the laws are enacted, administered and enforced is accessible, fair and efficient. 4. Justice is delivered timely by competent, ethical, and independent representatives and neutrals that are of sufficient number, have adequate resources, and reflect the makeup of the communities they serve. Establish the Rule of Law and Constitution of Bangladesh: The rule of law is a basic feature of the constitution of Bangladesh. It has been pledged in the preamble to the constitution of Bangladesh that – â€Å"It shall be fundamental aim of the state to realize through the democratic process a Socialist society, free from exploitation – a society in which the rule of law, fundamental human rights and freedom, equality and justice, political economic and social, will be secured for all citizens. † In accordance with this pledge the following positive provisions for rule of law have been incorporated in the constitution: Article 27 guarantees that all citizens are equal before law and are entitled to equal protection of law. Article 31 guarantees that to enjoy the protection of the law, and to be treated in accordance with law, is the inalienable right of every citizen, wherever he may be and of every other person for the time being with in Bangladesh, and in particular no action detrimental to the life, liberty, body, reputation or property of any person shall be taken except in accordance with Law. 18 fundamental rights have been guranteed in the constitutional arrangement for their effective enforcement has been ensured in Articles 44 and 102. Article 7 and 26 impose limitation on the legislature 4. that no law which is inconsistent with any provision of the constitution can be passed. In accordance with Article 7, 26 and 102(2) of the constitution the supreme court exercise the power of judicial review whereby it can examine the extent and legality of the actions of both executive and legislative and Constitutions declare any of their actions void if they do anything beyond their constitutional limits. Right to be governed by a representative body answerable to the people have been ensured under Articles 7(1), 11, 55, 56, 57 and 65(2) of the constitution. 18 all these provisions of constitution are effective for ensuring rule of law in Bangladesh. But facts on the ground tell a different story altogether. Rule of Law Ensure in Bangladesh: Laws, rules and procedures framed under them exist to cover every walk of our national life, though there may be parities in number and shortcomings in scope. Our constitution contain plethora of laws while institutions like courts, ministries and departments have been set up to dispense justice and decisions in accordance with the present state of the rule of law revels the riddle of having a body of law and at the same time not having it. It is like a person who is brain dead. Some aspects of the rule of law in our society and polity should be mentioned as under: First, accesses to law as well as equality before it are reserved for only those who are privileged. For the rest of the population, more or less the Hobbsian law of nature prevails. They are the helpless victims of as unjust society that sets great story by privileges. Second, all government in this country since the falls of Ershad have claimed that there is independence of judiciary. The claim is only partially true, while the higher courts enjoy a certain measure of independence; the lower courts are under the direct control of the law ministry. Nonetheless, the functional definition suffers from a number of difficulties. First, as with the substantive definition, the relationship between the legal system per se and the functional goal can pose problems. It is possible to constrain government officials or realize predictability through means other than the legal system. Suppose one society has less official discretion than its neighbor even though the latter has apparently more restrictive laws. 9. Which enjoys a greater rule of law under a functional definition? To reform the law enforcing agencies and police force to rid them out of corruption and to free them from political influence so that they could truly maintain the rule of law; 5. To forge national unity and politics of consensus built around the basic values of the constitution, namely democracy, respect for each others human rights, tolerance, communal harmony etc. 10. Conclusion: Above discussions clearly shows that the present condition of rule of law in Bangladesh is not satisfactory. They currently have 12 locations in Trinidad with plans to add 10 more by 2017. Their product line today includes bakery items such as bread, savoury pastries, sweet treats, cakes and their Lindas Fresh line consisting of salads, sandwiches, wraps, subs, bagels and coconut bakes. Macroeconomic Analysis GDP The Trinidad Tobago (TT) economy is predicted to continue sustainable growth (1.8-2.1%) over the short to medium term (see Figure 1.1), but less than in 2014 (2.3%). This will be driven by robust growth in the non-energy sector (2.0-2.5%) (IMF 2014). The main risk to Gross Domestic Product (GDP) growth in the energy sector – which contributes 40% of national GDP – will be a sustained decline in energy prices. At the current price of $45 for West Texas Intermediate crude oil (WTI), we anticipate a further downward revision of 2015 projected growth in the sector. We are of the opinion that both Liquefied Natural Gas (LNG) and WTI will remain at or around current prices, at least for 2015. This is in line with the International Monetary Fund (IMF) forecast for LNG but not for WTI (see Figure 1.2); however we agree that crude oil prices will not go into further decline given current circumstances. Interest Rates The Repo Rate was increased to 3.25% for three main reasons, to keep in line with expected increases in U.S. interest rates, the headline inflation rate – driven mainly by double digit food inflation, and continued steady performance in non-energy output (Kissoon 2014). We expect as the U.S. rates increase, so will the Repo Rate. The Federal Reserve is basing changes in its rate on economic performance however current indicators show mixed results. We expect that the rate of increase for both rates will be slower than originally anticipated. NFM recently adopted a more proactive relationship with its major stakeholders, including Lindas and the Seamen Waterfront Workers Trade Union (SWWTU), such as including them in its strategic planning. This bore positive results like a collective bargaining agreement for wages in place for 2013 to 2016 (Trinidad Express 2015). We would expect this proactive mindset to continue with the importation of wheat, if US wheat becomes too expensive. NFM can easily import wheat from Canada and Uruguay, two politically stable countries that NFM previously or currently imports other grains from. We don’t expect the fluctuations in the world wheat price to affect the price of NFM flour locally, as it is set by the government – NFM’s majority shareholder. This can be seen in flour – and bread – maintaining Value Added Tax (VAT) exempt status, the discounts offered on flour by the current administration, and other price fluctuations being absorbed except in 2011. Buyer Power Linda’s recently increased the prices on some products and, according to their CEO, this has had no effect on their sales. Lindas believes that once they have a quality product, their customers will pay the price for it. As such we are of the opinion that buyer power is not a major factor at this point in time. Competitive Rivalry Lindas is second in the bread market to Kiss Company Limited and they state that they are number one in the pastry business in the country. Whilst Kiss sells the same product bread we are of the opinion that they have different target markets. Kiss is available from groceries to sidewalk shops throughout the country, whereas Lindas products are only available in their stores. They are price makers utilizing product differentiation by offering a wider range of high quality products some of which may not found in other bakeries. They have also added a new line called Lindas Fresh to accommodate changing customer demands and to stay one step away from the competitor. Customer Analysis Analysis of Demand and Supply There is limited statistical data on demand and supply within the industry. Therefore we made assumptions using the theoretical concepts and behavioural changes in wheat imports and consumer purchasing. Wheat imports steadily declined from 2011 to 2014 from 140 to 135. It is projected at 135,000 MT in 2014/2015MY in the Trade report and current USDA World Markets (USDA 2015). The wheat import forecast fell by -2 (1.45%) thd. mt in the 2014/2015 in comparison to 2013/2014 season. The opening stock for 2014/2015 was 5 thd. mt (indexmundi.com 2015). Using this trend we can assume that the consumption of flour based products (such as bread) has decreased over the years. We can assume that this may be due to lifestyle changes considering â€Å"There is an explosion of diabetes in Trinidad and Tobago and the Caribbean and it is now the second leading cause of death in TT.† (Baboolal 2015) With a prevalence rate of 14.2% and an undiagnosed rate of 37.6%, it is possible that 1 out of 2 adults (20-79) in TT are diabetic (IDF 2015). We anticipate a surge of diabetic related issues over the medium to long term. According to the World Health Organization the life expectancy for Trinbagonians has increased from an average of 70.85 to 72.5 years. This can lead to suppliers producing less. Price Elasticity Lindas Bakery product is price inelastic. Their bread prices are lower when compared to Kiss Bakery; however Kiss is the market leader. Bread is considered to be a necessary commodity used in everyday life and is highly consumed in Trinidad. If there is an increase in price, then ceteris parabus, the quantity demanded will not decrease. The percentage of income spent is relatively low; there is a wide availability of substitutes, a high degree of necessity and no switching costs. As such they currently do not need to go for financing and are not affected by the increase in interest rate. This is another reason why we recommend Linda’s continue on its current expansion path. They can gain a competitive advantage through the application of technology. For example the introduction of an app can boost the companys visibility and brand awareness, generate sales and capture customer data to make projections. However, a major challenge for the company is the limited supply of labour in the country. Even though persons can seek employment at Lindas with limited experience, there exist easier options through government programmes. The application of technology above may also mitigate some of the burdens of in store staff by shifting the effort needed to the customer. Many of Thomas Hardy’s poems are centered on the feelings summoned up when reminiscing about the past. On the surface, it seems as though Hardy is ‘obsessed with the past’ as many poems are laced with memories which conjure up feelings of nostalgia. It is important to consider, however, that this doesn’t necessarily mean that he is infatuated with bygones. It may also be the case that Hardy’s poetry is a means for him to comprehend and come to terms with the present. Hardy tries to reclaim the past in his poem, ‘Under the Waterfall’. Fundamentally, the narrator – thought to be Emma – experiences a Proustian moment as she plunges her arm into a basin of water. This stimulation brings on an avalanche of memories, which are ‘fetched back from its thickening shroud of gray’ – symbolizing Hardy trying to rescue memories from the shroud of time. Emma feels anew the romantic feelings she felt on the day she dropped a drinking glass into the water, when she and her lover where having a picnic by a waterfall. Hardy utilizes a metaphor effectively, by referring to the day as being ‘fugitive’, which suggests that it is ephemeral and can be lost any moment. This particular memory of the past is a seemingly pleasant one as is suggested by the use of sibilance (ll 13-16). He gives this drinking-glass almost religious significance by sanctifying it and calling it a ‘chalice’. The chalice symbolized unity between Hardy and Emma, which still lies under the waterfall and ‘its presence adds to the rhyme of love persistently sung by the fall above’. Hardy uses rhyming couplets which give the poem a childish and youthful feel. This rhyming alludes to his youth being the ‘prime’ or best time of his life, and by summoning the past he can bring back the feelings of youth. Revival of the past is a recurring theme in many of Hardy’s poems. Similarly to ‘Under the Waterfall’, ‘At Castle Boterel’ also involves Hardy remembering a specific incident that took place between him and Emma. Emma is now dead, but in Hardy’s recollection her ‘phantom figure’ remains on the hillside. The poem is a powerful effort in consciousness to defeat the processes of time by reclaiming the past, as is shown in ‘Under the Waterfall’ also. On the other hand, the two settings have a stark contrast. Hardy drives to the junction of a line and highway with ‘drizzle bedrenching’; this suggests the somber and unhappy quality of the present. He looks behind at the byway, which is ‘fading’. This suggests increasing distance and decreasing significance of present reality as he delves into his past with Emma. There is use of enjambment in the between the first two stanzas, providing a sense of transition between Hardy’s present and past, and also his two states of mind. He speaks of how they walked along the road and creates a warm atmosphere in ‘dry March weather’. It is evident that the happy moments of the poem reflect Hardy’s love and what it used to be in the past. The last stanza consists of sharp words, completely unlike the melodious ones in ‘Under the Waterfall’. ‘My sand is sinking’, is a euphemism of Hardy’s approaching death. The sand conjures up the imagery of an hour-glass, once again referring to time passing relentlessly. In many of his poems, Hardy finds solace in the timelessness of many landscapes and tales. This suggests that Hardy has an inclination towards the past, because of the invariable constancy that it provides, regardless of passing time. For example, in the fifth stanza of ‘At Castle Boterel’, Hardy refers to the ‘Primaeval rocks’ in order to emphasise the great age and permanence of the hill by reflecting of how much transition they must have observed. Hardy asks if ever there was a ‘time of such quality’ in ‘that hill’s story’ and states that he believes there never were. This is, in a sense a defiance of time, as even time cannot alter the value of that one moment. The defiance of time is continued in the sixth stanza, as Hardy’s memory allows him to see ‘one phantom figure’ – Emma – even though ‘time’s unflinching rigour’ has killed the actual person. The idea of memory being eternal is once again portrayed in the poem ‘I Found Her Out There’. Hardy remembers Emma in Cornwall, and how she would sigh at the tale of ‘sunk Lyonnesse’, her hair beating against her face in the wind while she would listen to the ‘murmuring miles’. Hardy uses a technical aspect – synaesthesia – in order to combine two senses; this has a very powerful effect on the audience, giving the scene a sense of agelessness. The Arthurian tales also offer a link: As the myths of Lyonnesse belong to a fabled past, so too does the love story of Emma and Thomas Hardy. Additionally, this theme also echoes in ‘Under the Waterfall’, as Hardy refers to the ‘purl of a runlet that never ceases’ be it ‘in wars, in peaces’. Onomatopoeic diction in these lines is sounds like a flowing waterfall and represents the fact that it remains unchanged for a long period, unaffected by time. Hardy often uses the past objectively, in order to comfort him and assist him in dealing with his grief. ‘I Found Her Out There’ is a poem in which Hardy begins to dissociate himself from the anguish and guilt that consumed him after Emma’s death. This dissociation can be seen as he refers to Emma’s ‘shade’ as ‘it’ instead of ‘her’. He is beginning to come to acceptance of her death, as is shown by the controlled form of the poem. There are five uniform octaves, all following the rhyme scheme of ABBACDCD. Hardy ends the first stanza with the line, ‘The solid land’. This brings everything to a sudden, thumping halt and there is no mellifluous poetic beauty, as one would find in the poem, ‘Under the Waterfall’. Hardy is also conscious enough to effectively use contrasts of time in ‘I Found Her Out There’. He describes Emma in her youth, with the setting sun illuminating her face ‘fire-red’ against Emma as a corpse, never to be stirred in her ‘loamy cell’. This poem is less of a lament over the lost past, and more about capturing the essence of Emma. This is not always the case, however. In ‘Under the Waterfall’, Hardy finds it difficult to emotionally detach himself from the memory of the past. This is reflected in the structure, which can be jarring. The length of lines is not uniform, and this may suggest that Hardy’s mind wasn’t in a neutral state. He also asks many questions, such as ‘And why does plunging your arm in a bowl full of spring water, bring throbs to your soul?’ This portrays his internal turmoil. In conclusion, I believe that although Hardy had an inclination with the past, one cannot so far as to say that he was obsessed with it.
